These terms govern use of the UPPER website, portals, and related services. By creating an account, submitting an enquiry, or completing a booking you agree to them. Specific stay, host, partner, or reseller agreements may add to — and in a conflict, prevail over — this page for that relationship.

The platform

UPPER publishes a curated collection of homes and related guest-care and operations services. We are not a general marketplace. Listings, availability, and house rules are those shown at the time you book, in euro.

Some pages describe services that are configured, invited, or opening in stages (including partner and reseller programmes). A public page is an invitation to talk, not a promise that every capability is live for every home.

Accounts and eligibility

You must provide accurate details and keep login credentials confidential. You are responsible for activity under your account.

Host, organiser, partner, and reseller workspaces are granted according to UPPER’s onboarding process. Requesting access, or choosing an intent at sign-up, does not by itself create a commercial appointment.

Bookings and payment

A booking is formed when checkout completes successfully and we send confirmation. Until then, availability may change.

Payments are processed by Stripe. Prices are shown in EUR. Cancellation, alteration, and refund terms for a stay are those stated during checkout and in the confirmation, including any house-specific rules.

You must be authorised to use the payment method. Chargebacks made in bad faith, or stays obtained with misleading guest details, may lead to account suspension.

Stays, homes, and conduct

Guests must treat the home and neighbours with care, respect occupancy and event limits, and follow check-in instructions. Hosts and UPPER staff may refuse or end a stay that puts the property, staff, or other guests at risk.

Loss, damage, or extra services may be charged as described in the booking terms. Report problems promptly so we can put them right while you are still in residence.

Acceptable use

You may not misuse the site, attempt to access other accounts or non-public systems, scrape listings at scale, post unlawful content, or use UPPER to offer competing unauthorised rentals of homes you do not control.

We may suspend access where we reasonably believe these terms, payment rules, or applicable law have been broken.

Intellectual property and liability

The UPPER name, site design, and editorial photography remain ours or our licensors’. You may not copy the brand or listing presentation for another service.

The public site is provided as a carefully maintained service, but it may be unavailable during maintenance or events outside our control. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited under Spanish or EU law, including for fraud or personal injury caused by negligence.

We may update these terms as the product changes. Material changes will be reflected on this page with a new “last updated” date. Continued use after that date constitutes acceptance of the revised terms.

Governing law

These terms are governed by the laws of Spain. EU consumers keep any mandatory protections of their country of residence. Courts in Spain have jurisdiction, without prejudice to a consumer’s right to sue in their home courts where the law so provides.
